TERMS OF SERVICE – MTX DESIGNS

This website is operated by MTX Designs. Throughout the site, the terms “we”, “us” and “our” refer to MTX Designs. MTX Designs offers this website, including all information, tools, quotations, fabrication services and installation services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site, requesting a quotation, commissioning custom steelwork, or purchasing any product or service from us, you engage in our “Service” and agree to be bound by the following Terms of Service, including those additional terms and policies referenced herein. These Terms apply to all users of the site including browsers, customers, contractors and suppliers.

Please read these Terms carefully before using our website or confirming any order with MTX Designs. If you do not agree to all the terms of this agreement, you may not access the website or make use of our services.

Any new features, products or service categories added to MTX Designs shall also be subject to these Terms. We reserve the right to update or replace any part of these Terms by posting changes on our website. Continued use of the website or our services constitutes acceptance of those changes.

SECTION 1 – SERVICE AND FABRICATION TERMS

MTX Designs provides custom steel fabrication including but not limited to gates, balustrades, stair railings, pergolas, security barriers, laser-cut panels and general metal work. All items are manufactured to client specifications and measurements provided.

Quotations are valid for 14 days unless otherwise stated. Production will only commence once a deposit has been received and written approval of drawings, dimensions and finishes has been provided by the client.

Due to the custom nature of our work, minor variations in color, texture and finish may occur. These are not considered defects.

SECTION 2 – ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are the age of majority in South Africa or have consent from a legal guardian to use this site. You may not use our services for any illegal or unauthorized purpose or violate any laws including copyright and intellectual property laws.

SECTION 3 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate or exploit any portion of the Service without written permission from MTX Designs.

SECTION 4 – ACCURACY OF INFORMATION

Information on this site is provided for general purposes only. While we strive to ensure accuracy, dimensions, pricing and timelines are estimates until confirmed in writing after site measurement.

SECTION 5 – PRICING AND PAYMENTS

Prices are subject to change without notice due to material cost fluctuations. A deposit is required before fabrication begins. Final payment is due prior to delivery or upon completion of installation unless otherwise agreed in writing.

SECTION 6 – INSTALLATION AND DELIVERY

Installation dates are estimates and may change due to weather, supplier delays or site conditions. The client must ensure access to electricity, clear working space and structural readiness before installation.

MTX Designs will not be liable for delays caused by third‑party contractors or incomplete site preparation.

SECTION 7 – RETURNS AND REFUNDS

Custom manufactured items cannot be returned once fabrication has begun. Defects in workmanship will be repaired within a reasonable time in accordance with the Consumer Protection Act.

SECTION 8 – CPA AND POPIA COMPLIANCE

These Terms are aligned with the South African Consumer Protection Act (CPA) and the Protection of Personal Information Act (POPIA). Customers have the right to fair value, good quality and safety in all services provided.

Personal information collected through our website or quotations will only be used for the purpose of delivering our services and will not be shared with third parties without consent.

SECTION 9 – THIRD‑PARTY LINKS

Our website may contain links to third‑party suppliers or partners. MTX Designs is not responsible for the content or practices of those websites.

SECTION 10 – USER FEEDBACK

Any reviews, photos or testimonials submitted to MTX Designs may be used for marketing purposes unless the client requests otherwise in writing.

SECTION 11 – ERRORS AND OMISSIONS

We reserve the right to correct any errors relating to pricing, descriptions or specifications at any time.

SECTION 12 – PROHIBITED USES

You may not use this site for unlawful purposes, to spread malicious code, to infringe intellectual property, or to harass or defame MTX Designs.

SECTION 13 – WARRANTY AND LIABILITY

MTX Designs provides a workmanship warranty on installations for a period specified on your invoice. We do not guarantee products against misuse, alterations by third parties, normal wear and tear, or environmental damage.

In no event shall MTX Designs be liable for indirect or consequential damages arising from the use of our products or services.

SECTION 14 – INDEMNIFICATION

You agree to indemnify MTX Designs against any claim arising from your misuse of our products, incorrect measurements supplied, or modifications made by third parties.

SECTION 15 – SEVERABILITY

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect.

SECTION 16 – TERMINATION

We may terminate services if the client breaches these Terms or fails to make agreed payments.

These Terms constitute the entire agreement between you and MTX Designs regarding our services.

SECTION 18 – GOVERNING LAW

These Terms shall be governed by the laws of the Republic of South Africa and the jurisdiction of the Western Cape.

MTX Designs may update these Terms at any time by posting revisions on the website.
